2. DMCA Notice Requirements

To be effective under the DMCA, your written notice must include substantially the following information:

3. Counter-Notification

If you believe that material you posted on or through our website was removed or access to it was disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent.

To be effective, a counter-notification must include substantially the following:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, address, telephone number, and email address.

  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which TheProWakcas may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we may forward it to the original complaining party. The infringing material may be restored after a period of not less than ten (10) business days and not more than fourteen (14) business days, unless the copyright owner files an action seeking a court order against the allegedly infringing party.

4. Repeat Infringers

It is our policy, in appropriate circumstances and at our sole discretion, to disable and/or terminate the accounts or access of users who are repeat infringers of copyright or other intellectual property rights.

5. Misrepresentations

Please be aware that under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
